The purpose of the article is to inform readers of current legislation and the stance on telecommuting as a reasonable accommodation under federal law.<\/em><\/p>\n\n\n\n<div style=\"height:31px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p>Americans with disabilities have the right to work and are legally protected from employment discrimination. However, federal legislation does not require employers to provide accommodations that are not considered \u201creasonable.\u201d Is working from home considered a reasonable accommodation? It depends.<\/p>\n\n\n\n<p>American civil rights legislation prevents employers from discriminating against individuals with disabilities. However, employers are not obligated to provide accommodations that cause \u201cundue hardship\u201d on their companies. Though employers and state and federal governments see the value of remote work, telecommuting is not a reasonable accommodation by default.<\/p>\n\n\n\n<p>In this article, we discuss critical federal legislation that protects Americans with disabilities and the stipulations under which telecommuting may be considered a reasonable accommodation.<\/p>\n\n\n\n<div style=\"height:29px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-what-is-the-americans-with-disabilities-act-ada\"><strong>What Is the Americans with Disabilities Act (ADA)?<\/strong><\/h2>\n\n\n\n<p>The <a href=\"https:\/\/www.ada.gov\/ada_intro.htm\" target=\"_blank\" rel=\"noreferrer noopener\">Americans with Disabilities Act (ADA)<\/a> is a civil rights law that \u201cprohibits discrimination and guarantees that people with disabilities have the same opportunities as everyone else to participate in the mainstream of American life.\u201d It extends to employers, state and local governments, public transportation, public accommodations, commercial facilities, and telecommunications.<\/p>\n\n\n\n<p>The ADA was enacted on July 26, 1990 under the George H.W. Bush administration. It was revised by the ADA Amendments Act of 2008 under the George W. Bush administration and incorporated into the United States Code (U.S.C).<\/p>\n\n\n\n<p>Most of the ADA is listed in the U.S. Code under Title 42 \u2013 The Public Health and Welfare as <a href=\"http:\/\/uscode.house.gov\/browse\/prelim@title42\/chapter126&amp;edition=prelim\">Chapter <\/a><a href=\"http:\/\/uscode.house.gov\/browse\/prelim@title42\/chapter126&amp;edition=prelim\" target=\"_blank\" rel=\"noreferrer noopener\">1<\/a><a href=\"http:\/\/uscode.house.gov\/browse\/prelim@title42\/chapter126&amp;edition=prelim\">26 \u2013 Equal Opportunity for Individuals with Disabilities<\/a> (42 USC \u00a7 12101-12213). The U.S. Equal Employment Opportunity Commission (EEOC) enforces legislation that pertains to employment (42 U.S.C \u00a7 12111-12117 and some of 42 U.S.C \u00a7 12201-12213). Other involved organizations include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>U.S. Department of Justice (enforces laws related to public services and public accommodations)<\/li>\n\n\n\n<li>U.S. Department of Education (enforces laws related to public services)<\/li>\n\n\n\n<li>U.S. Department of Health and Human Services (enforces laws related to public services)<\/li>\n\n\n\n<li>U.S. Department of Transportation (enforces laws related to public transit)<\/li>\n\n\n\n<li>Federal Communications Commission (enforces laws related to telecommunication services)<\/li>\n<\/ul>\n\n\n\n<p>Though the U.S. Department of Labor Office of Disability Employment Policy develops and promotes policies for people with disabilities, it does not legally enforce the ADA.<\/p>\n\n\n\n<div style=\"height:30px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-how-does-the-ada-define-disability\"><strong>How Does the ADA Define \u201cDisability\u201d?<\/strong><\/h2>\n\n\n\n<p>The ADA defines a disability as \u201ca physical or mental impairment that substantially limits one or more major life activities, a record of such an impairment, or being regarded as having such an impairment.\u201d Examples of disabilities under the ADA may include the following:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Inability or inhibited ability to walk<\/li>\n\n\n\n<li>Hearing impairment<\/li>\n\n\n\n<li>Blindness<\/li>\n\n\n\n<li>Cancer that is in remission<\/li>\n\n\n\n<li>Speech impediments<\/li>\n\n\n\n<li>Prosthetic limbs<\/li>\n<\/ul>\n\n\n\n<p>However, the third clause in the definition, \u201cbeing regarded as having such an impairment\u201d means that impairments are not \u201cregarded as\u201d disabilities under the ADA if they are judged as transitory (expecting to last six months or less) and minor.<\/p>\n\n\n\n<p>For more information on how terminology within the definition can be used to file or challenge discrimination claims, visit the <a href=\"https:\/\/www.eeoc.gov\/laws\/regulations\/ada_qa_final_rule.cfm\" target=\"_blank\" rel=\"noreferrer noopener\">EEOC\u2019s Questions and Answers<\/a> page.<\/p>\n\n\n\n<div style=\"height:31px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-how-does-the-ada-help-american-workers\"><strong>How Does the ADA Help American Workers?<\/strong><\/h2>\n\n\n\n<p>The ADA protects American workers with disabilities from employment discrimination.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Businesses, government entities, employment agencies, and labor unions must not discriminate against individuals with disabilities at any point during employment, including hiring, compensation, benefits, professional development, promotion, and firing processes.<\/p>\n<\/blockquote>\n\n\n\n<p>The ADA also requires employers to provide reasonable accommodations to workers with disabilities. Workers are considered \u201cqualified\u201d if they satisfy the job requirements and can perform the job\u2019s essential functions.<\/p>\n\n\n\n<p>Employers must provide a reassignment option to workers who cannot perform their current essential job functions. However, employers do not have to offer reassignment if it causes undue hardship. Also, employers do not have to help workers qualify for job reassignments.<\/p>\n\n\n\n<div style=\"height:30px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-is-telecommuting-a-reasonable-accommodation-under-the-ada\"><strong>Is Telecommuting a Reasonable Accommodation Under the ADA?<\/strong><\/h2>\n\n\n\n<p><a href=\"https:\/\/www.eeoc.gov\/facts\/telework.html\" target=\"_blank\" rel=\"noreferrer noopener\">Telecommuting<\/a> may be considered a reasonable accommodation depending on whether essential job functions can be performed off-site. For example, jobs related to product assembly, food service, hospitality, and retail stores generally require on-site presence to perform essential functions. However, jobs with essential functions that do not require specific physical actions, equipment, tools, or face-to-face interaction may lend themselves to remote work.<\/p>\n\n\n\n<p>Examples of jobs that may be granted telecommute status include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Writer<\/li>\n\n\n\n<li>Translator<\/li>\n\n\n\n<li>Project Manager<\/li>\n\n\n\n<li>Customer Service Representative<\/li>\n\n\n\n<li>Software Developer<\/li>\n\n\n\n<li>Administrative Assistant<\/li>\n\n\n\n<li>Marketing Assistant<\/li>\n\n\n\n<li>Fundraiser<\/li>\n\n\n\n<li>Recruiter<\/li>\n<\/ul>\n\n\n\n<p>However, the <a href=\"https:\/\/www.eeoc.gov\/policy\/docs\/accommodation.html#types\" target=\"_blank\" rel=\"noreferrer noopener\">EEOC<\/a> states that employers are not required to offer telecommuting as a reasonable accommodation if they can prove that another option is more effective or that remote work causes undue hardship. Also, <a href=\"http:\/\/www.acc.com\/legalresources\/quickcounsel\/telecommuting-as-a-disability-accommodation.cfm\" target=\"_blank\" rel=\"noreferrer noopener\">Association of Corporate Counsel (ACC)<\/a> contributors remind individuals that, \u201cdifferent court[s] might reach a different conclusion on similar facts.\u201d Thus, employees must analyze their essential job functions, their employer\u2019s policies, and the ADA in detail to create a solid case. Examples of individuals include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Employees who experience a disabling workplace injury or illness<\/li>\n\n\n\n<li>Employees who experience a disabling injury or illness outside of work<\/li>\n\n\n\n<li>Individuals born with mental or physical impairments<\/li>\n\n\n\n<li>Individuals who experience physical or emotional trauma<\/li>\n\n\n\n<li>Individuals who experience onset mental or physical impairments<\/li>\n<\/ul>\n\n\n\n<p>Though your physical and mental state may influence the type of work you can perform, as long as you have Internet access and can use a computer, you can find remote employment. In fact, many employers provide telecommuters with necessary equipment or allow workers to use whatever equipment accommodates their needs best.
