“The State of California was the first state government in the United States to embark upon the idea that work could be performed in other than conventional offices that are typically located in central business districts,” according to “The State of California Telework-Telecommuting Program 1983-21st Century,” a survey available through the California Department of General Services.

The assumption is that telecommuting and working at home are synonymous; however, they can be very different. Telecommuting describes people employed by a company that either permits or encourages employees to work at home part or all of the time. In other ways, such as being salaried and eligible for company provided benefits, acting as part of a management hierarchy, and undergoing performance reviews, these employees fall under the same guidelines as those who work on-site.
However, independent contractors (freelancers) and the self-employed, who work out of a home office, are not, by law, salaried employees or eligible for benefits, including unemployment insurance. Typically, these workers are contracted for specific services, which can be performed on a one-time or long-term basis, and are paid according to the contract description.
